1) Introduction

2) Information about the HOMI Website & Mobile App

The HOMI Website & Mobile App is an online intermediary platform to display advertisements for products and services specialized in the fields of construction, architecture, engineering consultancy, decoration, furniture, and garden supplies.

Advertisements are displayed by service or product providers and sellers themselves, and users of the HOMI Website & Mobile App can search for the appropriate service or product through the categories, branches, and sections that we have designed and arranged clearly and distinctly.

The HOMI Website & Mobile App also provides the advantages of communicating with suppliers or vendors directly through correspondence via the application itself or direct contact with suppliers and sellers.

3) Access to the App and Website

The user is responsible for obtaining all the phone, computer, software, and other equipment needed to access and use the HOMI Website & Mobile App, and all related expenses.

You agree to comply with any and all instructions, notices, rules, operating policies, and instructions related to the use of the services and/or access to the HOMI Website & Mobile App. We reserve the right to review these instructions, notices, operating rules, policies, and instructions at any time, and you are aware of any changes to the above when they are posted on the HOMI Website & Mobile App.

4) Consent and Legal Capacity

Your access to and use of the HOMI Website & Mobile App must agree that you have the legal capacity to enter into this agreement, and that you are at least 18 years old. If you are a minor (under the specified age), you may use the HOMI Website & Mobile App services under the supervision of one of your parents or legal guardian, provided you agree to abide by the Terms of Use.

5) Memberships in HOMI Website & Mobile App

Anyone browsing or registering a membership on the HOMI Website & Mobile App must accept the following:

• Comply with all applicable laws and regulations in the United Arab Emirates when using the HOMI Website & Mobile App or its services.
• When creating an account on the HOMI Website & Mobile App, you are obligated to provide complete, correct, and accurate information in terms of name, phone number, email, and other required data, and you are responsible for reviewing this information periodically for the purpose of correcting, amending, or updating it whenever new information becomes available. • The user's consent that all activities that occur through their account are authorized by them and of their own free will, and they are responsible for any risks that occur as a result of any use.

6) Prohibited Activities

We reserve the right to terminate your use of the service or suspend your membership on the HOMI Website & Mobile App in the event of any violation or if you perform any of the prohibited activities.

All users are prohibited from the following:

• Using the services, products, or content for any commercial purpose outside the scope of those commercial purposes expressly permitted under this agreement, as well as the relevant guidelines, terms, and conditions provided by the HOMI Website & Mobile App.
• Using the HOMI Website & Mobile App or any service provided in an illegal or fraudulent manner, or in violation of any applicable laws, local and international regulations or regulations, or applicable customary rules, or as we estimate.
• Using the HOMI Website & Mobile App, services, or contents in any way - according to our sole discretion - in a manner that causes harm to our reputation or our trademark.
• Using the HOMI Website & Mobile App to infringe or violate the intellectual property rights related to us or others.
• Copying and pasting content or images belonging to individuals, entities, or companies (publishing them on the HOMI Website & Mobile App) without clear written permission.
• Posting or broadcasting any material that calls for ethnic intolerance or an offense against human dignity and humiliation.
• Collecting or tracking the personal information of others for any unethical purpose.
• Manipulating the price of any of the products or services offered on the HOMI Website & Mobile App.
• Promoting narcotic or psychotropic drugs, intoxicants, medicines, and preparations not licensed by the Ministry of Health, or tobacco products.
• Promoting any chemicals, weapons, or explosive materials.
• Interfering with other users' lists.
• Providing false or misleading information or data.

7) Chatting and Using the Messaging Feature through HOMI Website & Mobile App

When you use the messaging/chatting feature, you acknowledge and agree not to post or send electronic messages that:

• Constitute harm, abuse, threat, harassment, contain offense of religious beliefs, defamation of reputation, contain obscenity, pornography, sexual exploitation of children, defamation, infringe the privacy or rights of others, or incite hatred, racism, or encourage money laundering, illegal gambling, or have the potential to cause harm to minors in any way, or the content is illegal in any way.
• Disturb, insult, threaten, or incite hatred towards any individual or group of individuals based on religion, gender, sexual orientation, race, sect, age, or disability.
• Include any personal or identifiable information of another person without that person's explicit consent.
• Impersonate any individual or entity.
• Deceive or mislead the recipient of the origin of these messages or provide any information that is grossly hostile or involves risks and threats in nature.
• Is characterized by falsehood, deception, lying, or contains a “deceptive advertisement”.
• Includes links to commercial services or third-party websites, except as specifically permitted by the HOMI Website & Mobile App.
• Advertise any illegal services or sell any items whose sale is prohibited or regulated under applicable law, including but not limited to the sale of items whose sale is prohibited or regulated under

8) Availability of Products and Services

• We make all reasonable efforts to provide users with accurate and comprehensive data and information about the products and services offered on HOMI Website & Mobile App, such as product availability, prices, product or service specifications, and illustrations of the product or service in high colors and accuracy. We do not guarantee that your computer or cell phone displays colors accurately.
• We have the right, but are not obligated, to limit the sales of our products or services to any person or to a specific geographical region, and we may exercise this right on a case-by-case basis. We also have the right to limit the quantities of any of the products that we offer.
• We have the right, at our own discretion and at any time without prior notice, to change the details of the products or services or their prices, and we have the right to discontinue any product at any time. However, we strive to offer you the best prices on our website and our online application.
• Some errors may occur during the process of providing the product or service or providing detailed information about the prices on HOMI Website & Mobile App, so we are not responsible for any errors found during the completion of the request.

9) Value Added Tax (VAT 5%)

• VAT is a tax imposed by the state on all products and services, and it has been enforced with effect from January 1, 2018, with a value of 5% imposed on purchase orders through HOMI Website & Mobile App.
• HOMI Website & Mobile App acts as a broker between the seller and the buyer. Some products may be taxed at the seller’s discretion, as they may be registered with the tax authority and include tax in their prices. Other products may not be taxed if the seller is not registered with the UAE tax authority. Prices shown on the product or service page are final, and it will be clarified if the product is subject to tax or not in the product details.

10) Payment

• HOMI Website & Mobile App provides a service (service name here) through which users can pay non-refundable fees to publish their ads in selected sections, categories, and branches of HOMI Website & Mobile App via bank cards. Additional payment methods may be activated without notice to customers.
• You may have to transfer certain information via another service provider, the "payment gateway name" site, or a third-party site that may be subject to its own terms of use and other policies. HOMI Website & Mobile App does not guarantee the safety or security of information transferred to any third-party site. Your use of third-party sites is at your own risk, and HOMI Website & Mobile App disclaims any liability associated with that.
• All fees are due immediately through the payment methods available on the site, and we have the right to create, cancel, and/or review fees for any of the services provided through HOMI Website & Mobile App.
• You must ensure that the payment information is correct, accurate, and valid before completing the payment process.

11) Disclaimers

• HOMI Website & Mobile App does not guarantee that its application or server will be free from errors, unauthorized access, or that it will meet your requirements. We are not responsible for any data breach due to hacker attacks.
• HOMI Website & Mobile App and all information, content, materials, services, and user content listed on HOMI Website & Mobile App (collectively, “the contents of HOMI Website & Mobile App”) are provided on an “as is” basis, without any representations or warranties of any kind.
• You expressly agree that your use of our website and mobile application is at your own risk to the maximum extent permitted by law.
• The seller/publisher of the advertisement/advertiser acknowledges that HOMI Website & Mobile App is not responsible for any information or specifications related to any product or service offered on HOMI Website & Mobile App.
• You are solely responsible for your content, including written or published ads, information, photos, videos, or contact numbers that you post on HOMI Website & Mobile App.
• You must possess the necessary licenses, rights, approvals, and permits to use and publish any content on HOMI Website & Mobile App for the duration that the content is available on the app.
• We are not responsible for any use of user content that was placed, stored, or uploaded by you or by any third party on your behalf, or for any loss or damage that may be caused to the user's content.
• The user of HOMI Website & Mobile App undertakes to inspect and preview the products and services offered by the seller/provider/advertiser before communicating with or agreeing with them and acknowledges HOMI Website & Mobile App's disclaimer of any defects, problems, validity period, or delay in delivery related to the product or service.
• The user pledges to disclaim our responsibility for any bank transfers, payments, or fees made between them and the seller/provider/advertiser.
• The user pledges to disclaim our responsibility for any fraud they may encounter when communicating and dealing with the seller/provider/advertiser.
• We do not bear responsibility for the unavailability of products or services offered by advertisers or delays in receiving them. HOMI Website & Mobile App is an intermediary between the seller (advertiser) and the user (browser), but we seek to minimize risks and ensure the best user experience where possible.
• We do not bear responsibility for damages caused by mistakes, failure to deliver products or services, negligence, or failure to respond to communications by any seller. We will review complaints with sellers to ensure the best experience for users.
• You agree to indemnify us for any losses or damages resulting from failure to comply with these terms and conditions or due to your violation of these terms, and you must bear the costs and expenses of direct and indirect claims.
• We do not directly or indirectly cause any delay. We make reasonable efforts to ensure that all transactions are processed in a timely manner, but HOMI Website & Mobile App is not committed to the time required to complete any particular transaction and will not be liable for any loss.

12) Compensation

You agree to defend HOMI Website & Mobile App and its officials, directors, employees, and agents, and indemnify them for any claims, causes of claims, refunds, losses, damages, fines, penalties, costs, or other expenses, including legal and accounting fees, resulting from:

• Your violation of this Agreement;
• Your violation of any law or the rights of others;
• Your use of the services, including HOMI Website & Mobile App.

13) Intellectual Property Rights

• HOMI Website & Mobile App and all associated logos, images, page headers, button icons, icons, software, designs, graphics, texts, and service names are trademarks and designs of HOMI Website & Mobile App. Reproduction or distribution of these elements in any media or advertising without our written permission is prohibited.
• All copyrights and other intellectual property rights in this website and mobile application (including but not limited to text, graphics, and other content) are owned or controlled by HOMI Website & Mobile App or its licensors.

15) Force Majeure

HOMI Website & Mobile App shall not be held responsible for any delay or failure in the delivery of content, services, or products resulting directly or indirectly from acts of nature or force majeure, or causes that exceed our reasonable control. This includes, but is not limited to, failures in internet, computer, communications, or other equipment, power outages, strikes, labor disputes, riots, insurrections, civil unrest, labor or material shortages, fires, floods, explosions, war, government actions, orders from domestic or foreign courts or judicial bodies, or the non-performance of third parties.

16) Amendment or Change of Terms and Services

We reserve the right to amend, change, add, or supplement these terms of use at any time at our sole discretion. The current version of the terms of use will be published on the site, and they will be in effect from the date they are published. By using HOMI Website & Mobile App after the update date, you agree to be bound by the modified terms of use.

18) Termination

We reserve the right to terminate, restrict, or stop any user from accessing HOMI Website & Mobile App or using its services without notice, for any reason, and without providing justification. This includes, but is not limited to, behavior that we consider illegal or harmful to others. 19) Laws and Jurisdiction

• If any part of this agreement is determined to be invalid or ineffective according to applicable law, another valid and enforceable provision that corresponds more closely to the content of the original provision will replace the invalid or ineffective provision, without affecting the legality, validity, and enforceability of the other provisions contained in this agreement.
• You agree to indemnify HOMI Website & Mobile App, its directors, employees, and agents, and protect them from any claims, losses, damages, costs, or expenses resulting from your violation of the user agreement or any law.
